1. Agreement to these Terms
By creating an account or using the Yardovo app, website, or services (the "Platform"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Platform. If you use the Platform on behalf of a business, you confirm you're authorized to bind that business. In these Terms, "Yardovo," "we," "us," and "our" refer to Yardovo.
2. Who can use Yardovo
You must be at least 18 years old and able to enter a binding contract. You must provide accurate information and keep it up to date.
3. What Yardovo is — and isn't
Yardovo is an online marketplace that connects Property Owners (people or businesses who own, operate, or are authorized to request service for a property) with Contractors (independent businesses offering snow removal, lawn care, landscaping, and related outdoor services).
Yardovo is a venue, not a party to the work agreement. When a Property Owner accepts a Contractor's bid, the resulting agreement for the work is between the Property Owner and the Contractor. Yardovo does not perform the services, does not employ Contractors, and is not responsible for the quality, safety, timing, legality, or outcome of any job. Contractors are independent contractors, not employees or agents of Yardovo.
4. Accounts
You're responsible for activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms.
5. Property Owners
- Authorization. By posting a job you confirm you own, operate, or are authorized to request service at that property. You must not post jobs for properties you have no right to.
- Accurate jobs. Outline the work area honestly. The map-based measurement and reference price are estimates only.
- Payment method. You must add a valid payment method before accepting a bid. By accepting a bid you authorize the charge for the agreed amount plus the applicable service fee.
- Dealing with Contractors. You choose which bid to accept and are responsible for granting any property access the work requires and for your own safety and property.
6. Contractors
- Subscription required to bid. Contractors must hold an active subscription to place bids. Posting is free; bidding is not.
- Verification. Before bidding you must submit and maintain accurate verification details, which may include a business license/registration number, workers' compensation (WCB) number, proof of liability insurance, and government photo ID. You must keep insurance and licenses valid and current.
- Independent business. You operate as an independent business and are solely responsible for your work, workers, equipment, taxes, insurance, and compliance with all laws, licensing, and safety requirements that apply to your services.
- Honest bids and work. Bid prices you can honor and perform work you're qualified and equipped to do.
- Payouts. Approved payouts are made through our payment processor after a job is marked complete, minus the platform service fee.
7. Fees and payments
- Free to post. Posting jobs is free for Property Owners.
- Contractor subscriptions. Subscriptions are billed monthly or yearly at the rates shown in the app at the time you subscribe, and renew automatically until cancelled. You can cancel anytime before the next renewal; cancellation stops future billing but does not refund the current period unless required by law.
- Service fee. Yardovo charges a size-based platform service fee on accepted jobs, disclosed before acceptance.
- Payment processing. Payments and payouts are handled by our third-party processor (Stripe) and are also subject to Stripe's terms. We do not store full payment card numbers.
- Taxes. You're responsible for any taxes that apply to your transactions, including, for Contractors, taxes on income earned through the Platform.
8. Verification is not a guarantee
We take reasonable steps to verify Contractors, but we do not guarantee any Contractor's qualifications, licensing, insurance, work quality, or conduct, and we do not guarantee any Property Owner's identity or authority. Use your own judgment and confirm details that matter to you.
9. Ratings and content
Property Owners may rate and review completed jobs. You agree your ratings and any content you submit are honest, lawful, and not defamatory, infringing, or abusive. You grant Yardovo a non-exclusive, royalty-free licence to host, display, and use content you submit for operating and promoting the Platform. We may remove content that violates these Terms.
10. Prohibited conduct
You agree not to: post false, misleading, or unauthorized jobs; circumvent the Platform to avoid fees; harass, discriminate, or endanger others; submit forged verification documents; scrape, hack, or disrupt the Platform; or use it for anything unlawful.
11. Cancellations and disputes
Property Owners and Contractors should communicate promptly about scheduling and completion. Disputes about the work itself are between the Property Owner and the Contractor. Yardovo may, at its discretion, help mediate, adjust a charge, or remove a user, but is not obligated to resolve disputes.
12. Intellectual property
The Platform, including the Yardovo name, logo, software, and content (excluding user-submitted content), is owned by Yardovo and protected by law. You may not copy, modify, or reuse it without permission.
13. Disclaimers
The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We don't warrant that the Platform will be uninterrupted or error-free, or that any job will be posted, bid on, or completed.
14. Limitation of liability
To the fullest extent permitted by law, Yardovo is not liable for indirect, incidental, special, consequential, or punitive damages, or for any property damage, injury, loss, or dispute arising from work arranged through the Platform. Our total liability for any claim is limited to the greater of (a) the fees you paid Yardovo in the three months before the claim, or (b) CAD $100. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Yardovo from claims, damages, and costs (including reasonable legal fees) arising from your use of the Platform, your jobs or work, your content, or your violation of these Terms or any law.
16. Governing law
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Calgary, Alberta, except where applicable law gives you the right to bring a claim elsewhere.
17. Changes
We may update these Terms. Material changes will be posted in the app or on the website with an updated effective date. Continued use after changes means you accept them.
18. Termination
You may stop using the Platform anytime. We may suspend or terminate access for any violation of these Terms or to protect the Platform or its users.
